What is Intra Company Transfer?

Last Updated: January 17, 2022

Intra-company transfers to Canada are a standard option for foreign workers to migrate to Canada. You may obtain a Canadian work visa under the Intra-company transfer program if you work for a firm that has a parent company, branch, subsidiary, or affiliate in Canada.

Through the Intra-company transfer program, approved applicants receive a temporary work visa. Because Canadian work experience is highly prized under Canada’s points-based immigration system, job experience earned as an intra-company transferee in Canada can be utilized as a springboard to permanent residency in Canada.

Family members of the foreign worker may accompany them to Canada, and the spouse or common-law partner of the intra-company transferee may work in Canada on an open work permit.

Employers who bring staff from other countries to Canada as an intra-company transfer are excluded from the Labor Market Impact Assessment requirement. As a result, the procedure may be faster, easier, and less expensive than the LMIA way. By transferring their talents and knowledge to the Canadian labor market, qualified intra-company transferees give Canada a “substantial economic advantage.” Intra-company transferees come from all over the world.

Categories of the Intra-Company transfer to Canada:

Foreign employees must fit into one of three categories to be eligible to work in Canada under the Intra-Company Transfer program:

Executives:

Executives are largely responsible for the administration of the company, or a significant portion of it, and receive only general (if any) oversight from higher-ranking executives.

Senior managers:

Senior managers are in charge of the entire company or a portion of it and supervise or control the work of other managers or professional staff.

Experienced Workers:

Workers with ‘specific knowledge’ can show a high degree of skill in the company’s processes and procedures and technical understanding of the company’s product or service.

Workers being moved to Canada must have at least one year of full-time work experience with a foreign company and perform the equivalent job in Canada. For a work visa to be issued, there must be a qualifying relationship between the employer and the employee.

Intra-company transferees make the transition to permanent residency:

Intra-company transferees are frequently in an excellent position to become permanent residents of Canada if they so want. Permanent residents are allowed to live and work anywhere in Canada.

Express Entry, Canada’s immigration screening system, has been the primary driver of economic immigration to the country since its inception in 2015. Intra-company transferees seeking permanent residence can acquire Comprehensive Ranking System (CRS) points without first receiving an LMIA, making it very easy to improve their CRS score. As a result, their chances of being invited to apply for permanent residency improve.

Outside of the Express Entry system, there may be other ways to move to permanent residencies, such as through one of the Provincial Nominee Programs.

Some persons who come to Canada as intra-company transferees may eventually become naturalized Canadian citizens. After you’ve been granted permanent residency, you’ll need to do this step.
